It’s best to seek the help of a nurse attorney when facing accusations and allegations relating to drug use. However, some nurses tend to face these results instead without thinking that nurse attorneys are always reliable for matters such as these.
On or about February 26, 2016, while employed as a Registered Nurse at a hospital facility in Mesquite, Texas, the RN engaged in the intemperate use of Amphetamines, Methamphetamines, and Cocaine, in which he produced a specimen for a drug screen which resulted positive for Amphetamines, Methamphetamines, and Cocaine. Unlawful possession of Amphetamines, Methamphetamines, and Cocaine is prohibited by Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code. The use of Amphetamines, Methamphetamines, and Cocaine, by a Registered Nurse, while subject to call or duty, could impair the nurse’s ability to recognize subtle signs symptoms, or changes in a patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decision regarding patient care, thereby placing the patients in potential danger.
In response, the RN submitted sixteen (16) negative drug screens for the time period of March 12, 2016, through March 16, 2017.
The Texas Board of Nursing sent a letter to the LVN regarding the issue so then she can have the chance to defend herself. However, she was not able to provide a good defense for herself. Therefore, the Board placed her LVN license to a disciplinary action instead.
