Any type of accusation or negligence can be defended, as long as there is a skilled nurse attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action, or revocation.

At the time of the initial incident, an RN was employed as a Registered Nurse at a hospital facility in Arlington, Texas, and had been in that position for three (3) years and five (5) months.

On or about March 16, 2016, through April 15, 2016, while employed as a Registered Nurse, the RN withdrew five (5) syringes of Hydromorphone 2mg, two (2) syringes of Hydromorphone 4MG, twenty-six (26) tabs of  Hydrocodone 10/325MG, nineteen (19) tabs of Oxycodone-Acetaminophen and fourteen ( 14) tabs of Oxycodone 15MG from the medication dispensing system for patients but failed to document, and/or accurately and completely document the administration of the medications in the patients’ Medication Administration Record (MAR) and/or Nurse’s Notes. The RN’s conduct was likely to injure the patients, in that subsequent caregivers would rely on her documentation to further medicate the patients, which could result in an overdose. Additionally, the RN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

On or about March 16, 2016, through April 15, 2016, while employed as a Registered Nurse, the RN withdrew five (5) syringes of Hydromorphone 2mg, two (2) syringes of Hydromorphone 4MG, twenty-six (26) tabs of Hydrocodone 10/325MG, nineteen (19) tabs of Oxycodone-Acetaminophen and fourteen ( 14) tabs of Oxycodone 15MG from the medication dispensing system for patients but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications. The RN’s conduct left medications unaccounted for, was likely to deceive the hospital pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

On or about March 1 8, 2016 through April 13, 2016, while employed as a Registered Nurse, the RN withdrew one (1) syringe of Hydromorphone 4MG, sixteen (16) tabs of Hydrocodone 10/325MG, six (6) tabs of Oxycodone-Acetaminophen and two (2) tabs of Oxycodone 15MG from the medication dispensing system for patients not assigned to her care. The RN’s conduct was likely to injure the patients in that the RN had not taken a report on the patients and was unaware of the patients’ current conditions. In addition, the RN’s conduct was likely to deceive the pharmacy and patient about the cost of the medication.

On or about March 18, 2016, through April 15, 2016, while employed as a Registered Nurse, the RN withdrew Hydrocodone 4MG, Hydrocodone 10/325MG, Oxycodone-Acetaminophen, and Oxycodone 15MG from the medication dispensing system for patients in the excess frequency of the physician’s orders. The RN’s conduct was likely to injure the patient in that the administration of medication in excess frequency and/or dosage of the physicians’ orders could result in the patient suffering from adverse reactions. Additionally, the RN’s conduct placed the hospital in violation of Chapter 48 1 (Controlled Substances Act) of the Texas Health and Safety Code.

In response, the RN denies withdrawing or misappropriating medications. The RN adds that she has denied the opportunity to submit a drug screen when confronted and she completed one on her own on April 22, 2016, which resulted in a negative.

Because of this incident, the Texas Board of Nursing then subjected the RN and her license to disciplinary action.
