Any RN or LVN who is guilty of violating state laws and issuances from the Texas Board of Nursing (BON) may be subjected to penalties or fines if not properly defended by a nurse attorney. As a matter of fact, the RN license and LVN license can even be suspended or revoked.

At the time of the initial incident, an RN was employed as a Registered Nurse at a hospital facility in Amarillo, Texas, and had been in that position for eight (8) months now.

On or about November 21, 2016, while employed as a Registered Nurse, the RN withdrew one (1) vial of Morphine 2mg/ml from the medication dispensing system for patients but failed to follow the facility’s policy and procedures for wastage of the unused portions of the medications. The RN’s conduct left medications unaccounted for, was likely to deceive the hospital pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

On or about November 21, 2016, while employed as a Registered Nurse, the RN misappropriated one (1) vial of Morphine 2mg/ml from a patient or failed to take precautions to prevent such misappropriation. The RN’s conduct was likely to defraud the facility and patients of the cost of the medications.

On or about November 22, 2016, through November 24, while employed as a Registered Nurse, the RN withdrew Morphine 4mg/ml, Morphine 2mg/ml, and Hydromorphone 1mg/ml in excess frequency and/or dosage of the physicians’ orders. The RN’s conduct was likely to injure the patients in that the administration of medications in excess frequency/dosage of the physician’s order could result in the patients suffering from adverse reactions. Additionally, the RN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

As a result, the Texas Board of Nursing placed her RN license to disciplinary action. It’s too bad that she failed to hire a nurse attorney for assistance, knowing that she had every reason to defend herself in the first place. Her defense would have gotten better if she actually sought legal consultation from a Texas nurse attorney as well.
