On or about July 26, 2018, through July 27, 201 8, while employed as a Registered Nurse, the RN lacked the fitness to practice nursing in that he exhibited signs of impaired behavior while on duty, including, but not limited to: red eyes, stuttered when he spoke, and was confused. Furthermore, the RN had a fresh needle stick with blood on his forearm. Additionally, the RN’s first urine sample was cold and smelled like the soft drink he carried into the restroom and his second urine sample appeared to be water. Respondent subsequently admitted he used intravenous drugs. The RN’s condition could have affected his ability to recognize subtle signs, symptoms, or changes in patient’s conditions, and could have affected his ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger.
On or about July 26, 2018, while employed as a Registered Nurse, the RN withdrew three (3) vials of Hydromorphone 2mg and one (1) vial of Fentanyl 100mcg from the medication dispensing system for the patient but failed to administer and/or document and/or accurately and completely document the administration of the medication in the patients’ Medication Administration Record (MAR) and/or Nurses’ Notes. The RN’s conduct was likely to injure the patient, in that subsequent caregivers would rely on his documentation to further medicate the patient, which could result in an overdose. Additionally, the RN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
On or about July 26, 201 8, while employed as a Registered Nurse, the RN withdrew Fentanyl 100mcg from the medication dispensing system of a patient and failed to document the pain assessment in the patient’s medical records. The RN’s conduct was likely to injure the patient from clinical care decisions formulated based upon incomplete assessment information.
On or about July 26, 20 1 8, while employed as a Registered Nurse, the RN withdrew three (3) vials of Hydromorphone 2mg and one (1) vial of Fentanyl 100mcg from the medication dispensing system of the patient but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications. The RN’s conduct left medications unaccounted for, was likely to deceive the hospital pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
On or about July 26, 2018, while employed as a Registered Nurse, the RN misappropriated three (3) vials of Hydromorphone 2mg and Fentanyl 25mcg belonging to the facility and patients thereof or failed to take precautions to prevent such misappropriation. The RN’s conduct was likely to defraud the facility and patients thereof of the cost of the medications.
On or about July 27, 20 1 8, while employed as a Registered Nurse, the RN withdrew Morphine 4mg/ml from the medication dispensing system of a patient but failed to document and/or accurately and completely document the administration of the medication in the patients’ Medication Administration Record (MAR) and/or Nurses’ Notes. The RN’s conduct was likely to defraud the facility and patients thereof of the cost of the medications.
ln response, the RN states he was psychologically and emotionally drained and gave himself Hydromorphone intravenously. The RN relates he took two (2) vials of Hydromorphone from the patient and administered them to himself, but denies taking the third vial of Hydromorphone or the Fentanyl. Furthermore, the RN states his orientation properly wasted the Morphine 4mg due to patient revisal.
Because of the incident, the RN was disciplined and suspended by the Board of Nursing.
The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN licenses.
