There are instances where a nurse attorney can be very useful whenever an RN or an LVN faced charges, complaints, or any accusations. At the time of the initial incident, an RN was employed as a Registered Nurse at a hospital in Midlothian, Texas, and had been in that position for three (3) years and seven (7) months.

On or about October 23, 2017, while employed as a Registered Nurse, the RN failed to appropriately intervene and/or consult with the physician in a timely manner, when the patient called the clinic and reported constant, burning chest and back pain rated up to 7/10. Instead, the RN sent a routine message to the physician and scheduled an appointment for the patient on October 25, 2017. Subsequently, the patient’s symptoms did not improve and she went to the emergency department the same night, where she was assessed for myocardial infarction or pulmonary embolism, and admitted for overnight observation. The RN’s conduct exposed the patient to a risk of harm from a delay in treatment needed to prevent further complications.

In response, the RN reports she sent the telephone encounter to the patient’s physician and the nurse pool. Unfortunately, nobody reviewed the encounter to give her any advice. The RN reports she learned the lesson that clinic quality care was over patient financial concern.

As a result, the RN was given disciplinary action by the Texas Board of Nursing (BON). And also, her lack of an experienced nurse attorney to properly defend her case led to the suspension of her license which also affected her career as an RN. The RN was also said to be under probation due to her misconduct.
