A Nurse can face a lot of accusations, allegation cases, or complaints cases especially when you are questioned about you being fit as a nurse and then face the Texas Board of Nursing to formally follow procedures. But if a nurse is experiencing such a problem, a nurse attorney can be their line of defense that can assist them in dealing with the cases they are facing.
At the time of the initial incident, an RN was employed as a Registered Nurse at a hospital in Round Rock, Texas, and had been in that position for one (1) month.
It was on or about April 18, 2019, the RN lacked the fitness to practice nursing in that she exhibited signs of impaired behavior while on duty, including, but not limited to: swaying, having glassy eyes, being unsteady on her feet, stumbling over her words, drooling, and having the smell of alcohol on her breath. In addition, the RN admitted to taking Xanax for a headache approximately two and half hours after beginning her shift. The RN’s condition could have affected her ability to recognize subtle signs, symptoms, or changes in patient’s conditions, and could have affected his/her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger.
And on or about February 1, 2020, the RN underwent a Medical Evaluation by an M.D., who stated that the RN was found to be “medically fit to continue to practice as a Registered Nurse in the state of Texas.”
In response, the RN states she realizes her lapse in professional judgment has cost the board valuable time & resources and requests that her license reflects her retirement.
As a result of the RN’s misconduct, the RN was subjected to disciplinary action by the Texas Board of Nursing. The further sanction may apply against the RN if proven guilty of the violation.
The case would have yielded a different result if the RN was able to hire a nurse attorney. So if you also have the same cases or concerns, it’s best to contact Nurse Attorney Yong J. An, for further details. You may contact him at (832) 428-5679 to get a schedule for a confidential consultation.
