Being a nurse and seeing patients recover with such great results is very rewarding to nurses. However, some nurses tend to do their duties in an inappropriate manner. At the time of the initial incident, he was employed as an RN at a dialysis center in Plano, Texas, and had been in that position for eight (8) years and five (5) months.
On or about October 16, 2019, while employed as an RN at a dialysis center in Plano, Texas, RN inappropriately asked a patient if she would like to walk to her dialysis chair for treatment when she was not ambulatory and had been pushed in her wheelchair into the facility due to limited mobility. Additionally, RN allowed an unlicensed health tech to place the patient’s wheelchair in front of her to use as a walker as the health tech walked behind the patient without appropriate support devices in place. Subsequently, the patient’s wheelchair rolled forward causing the patient to fall onto the ground resulting in a broken wrist. RN’s conduct placed the patient at risk of harm and contributed to her injury.
In response, the RN states he asked the patient if she felt like walking to her dialysis chair and the patient said that she would do so. According to RN, the patient had walked at the clinic on occasion. RN continues that the Certified Clinical Hemodialysis Technician (CCHT) positioned the wheelchair in front of her so she could grip the handles like a rolling walker. RN states he started doing paperwork when he heard the patient yell out and saw the patient was on the floor. RN states the CCHT was three feet behind and tried to grab the patient to break the fall as her wheelchair pulled away from her. RN states the patient reached down with her right hand to brace her fall, but she slipped through the hands of the CCHT and fell onto her right hand and knees then into a sitting position.
The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(B) and 22 TEX. ADMIN. CODE §217.12 (1)(D)&(4).
However, without enough evidence to prove he’s not guilty, the RN lost the case. This is the reason why the Texas Board of Nursing placed his RN license under disciplinary action.
