False documentation is a serious case, which is why a nurse attorney is needed if you get accused of this kind of scenario. On or about January 30, 2020 and February 25, 2020, respectively, while employed as an LVN with a home health care services provider in Texarkana, Texas, LVN documented a recertification visit and a subsequent skilled nurse visit for a patient that were not made, as the patient was hospitalized during these times. LVN’s conduct resulted in an inaccurate medical record and was likely to injure the patient in that subsequent care givers would rely on her documentation for further care.

In response, LVN states that the documented visits were made, however he inadvertently entered into the wrong patient’s chart. When the LVN and his supervisor discovered the error, the documentation was corrected and LVN states he was told there was nothing more he needed to do. At the time, LVN had been working above standard productivity levels and also dealing with significant family discord, which led to him accidentally selecting the wrong patient from his electronic list when performing the visits.

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(D)&(3)(A) and 22 TEX. ADMIN. CODE §217.12 (1)(A),(1)(B),(1)(C)&(4).

However, without enough evidence to prove he’s not guilty, the LVN lost the case. This is the reason why the Texas Board of Nursing placed his LVN license under disciplinary action.
