Every practicing RN license holder in the state of Texas is required to follow certain rules and regulations imposed by the government. These laws and statutes were implemented to ensure that the safety of the patients is protected by the state. An RN / LVN who commits any violation can place his / her License in jeopardy. The Texas Board of Nursing has the authority to revoke or suspend an RN license in the country for as long as there is a justifiable reason. On or about June 5, 2020, through October 18, 2020, while employed as an RN at a hospital in Odessa, Texas, RN falsely documented forty-six (46) visits for twenty (20) patients that did not occur. RN’s conduct created an inaccurate medical record and was likely to deceive other caregivers who needed complete information on which to base their care.

On or about December 19, 2020, while employed as an RN at a hospital in Odessa, Texas, and assigned to provide nursing services for a patient, RN did the following:

  1. RN failed to perform a catheter change causing the patient to go weeks without a new catheter. When the catheter was changed, the catheter tip was covered in mucous/sediment. RN was likely to injure the patient and unnecessarily exposed them to risk of harm from possible infections.
  2. RN falsified nursing notes for a visit he did not complete. RN’s conduct created an inaccurate medical record and was likely to deceive other caregivers who needed complete information on which to base their care.

The above actions constitute grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),(1)(D)&(1)(M) and 22 TEX. ADMIN. CODE §217.12(1)(B),(1)(C),(6)(A)&(6)(H).

Unfortunately, the Texas Board of Nursing found him guilty of his deeds. His RN license was subjected to disciplinary action. He did not hire a skilled Texas BON attorney to fully defend his case which led to this decision by the Texas Board of Nursing.
