On or about March 7, 2018, through March 8, 2018, the RN allegedly signed out Hydrocodone from the individual controlled drug record for several patients but failed to accurately document the administration of the medications in the patient’s Medication Administration Records and nurse’s notes.

The RN’s conduct was likely to injure the patients, in that subsequent caregivers would rely on her documentation to further medicate the patients, which could result in an overdose.

The RN’s conduct was likely to injure the patient in that failure to administer medications as ordered by the physician could have resulted in non-efficacious treatment. Additionally, her conduct placed the facility in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

In response to the allegations, the RN states she documented on the narcotic sign out sheet as well as the resident’s medication administration record. She states she documented pain medication effectiveness behind the MAR because there was not a separate pain management sheet to chart on. She states one patient had requested pain medications at times that were eligible as they were given 3.5 — 4 hours apart. She states the resident had come to the nursing cart each time on 3/8/18 and requested the pain medication. She also states all medications were given by herself and accepted by patients so no need for waste, therefore she states no medications, hydrocodone or otherwise, were misappropriated by herself. She states the patient received the medications per request for pain, as prescribed by the physicians,
