If not defended by a Breckenridge nurse license attorney, your license could be put in danger whenever someone filed a complaint against you. L150119N2444

At the time of the initial incident, the LVN was employed as a Licensed Vocational Nurse in a hospital in Breckenridge and had been in this position for four months.

On or about January 15, 2014, the LVN disclosed confidential information and knowledge to members of the public regarding an emergency room patient, in a manner that was inconsistent with the patient’s treatment in that she informed an off-duty coworker of the arrival of the patient and patient’s family to the emergency room.

At the request of the coworker, the LVN took a photo of a visitor who accompanied the patient and sent it to an off-duty coworker via her cell phone.

The LVN’s conduct exposed the patient unnecessarily to a risk of harm from disclosure of her confidential medical information without her written authorization and constitutes a violation of HIPAA (The Health Insurance Portability and Accountability Act).

Because of this, the LVN was summoned by the Texas Board of Nursing to defend her side.

During the hearing, the LVN admits that she notified the off-duty coworker that her niece was a patient in the emergency room, and the coworker asked her to take a photo of the visitor that was with the patient and mother. She states that she took a photo of the visitor only with no other people or identifying information.

The LVN sent the photo via text message to the coworker. The LVN states that she has since attended HIPAA education class through her employer, and she takes full responsibility for the mistake.

However, the LVN failed to hire an effective Breckenridge nurse license attorney to help her with her case. Because of this, the Texas Board of Nursing suspended and disciplined the LVN.
