An experienced Fort Worth RN lawyer has surely helped a lot of RNs and LVNs when it comes to cases that may lead toward disciplinary action. Unfortunately, not all nurses were able to hire a Fort worth RN lawyer as they underwent such cases. This incident that an RN committed in 2019, was one of those examples.
At the time of the initial incident, the RN was employed as a Registered Nurse in Fort Worth and had been in that position for four (4) months.
On or about April 21, 2019, through May 22, 2019, the RN withdrew one (1) tablet of Acetaminophen/ Codeine (Tylenol #3) 300/30mg and one (1) tablet of Zolpidem 10mg from the medication dispensing system for patients but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications. Her conduct left medications unaccounted for, was likely to deceive the hospital pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.
The RN also withdrew one (1) tablet of Acetaminophen/ Codeine (Tylenol #3) 300/30mg, one (1) tablet of Zolpidem 10mg, and one (1) injection of Morphine 2mg/1mL from the medication dispensing system for patients but failed to document and/or accurately and completely document the administration of the medication in the patients’ Medication Administration Record (MAR) and/or Nurses’ Notes.
Subsequently, she misappropriated one (1) tablet of Acetaminophen/ Codeine (Tylenol #3) 300/30mg and one (1) tablet of Zolpidem 10mg belonging to the facility and patients thereof, or failed to take precautions to prevent such misappropriation. Her conduct was likely to defraud the facility and patients of the cost of the medications.
During the hearing, the RN states the allegations are false and unfounded. However, without enough evidence and an expert Fort Worth RN lawyer on her side, the RN was disciplined and suspended.
The following incident and defense against the case caused the Texas Board of Nursing to place the LVN and her license into disciplinary proceedings. She would have sought assistance from a good Fort Worth RN lawyer to provide clarifications towards the case.
