On or about December 11, 2007, an LVN was charged of OBTAINING CONTROLLED DRUG BY FRAUD (a felony offense committed on September 24, 2007)

As a response to her case, the LVN states she suffered from a self-proclaimed addiction to Xanax and was never diagnosed or treated for the addiction. She was diagnosed with postpartum depression after her son was born in 2005. The LVN ran out of Xanax and called the psychiatrist to have the prescription refilled but could not get it done until she came in to see the doctor. Panic set in and she dialed the number for a local pharmacy and tried to refill the prescription for Xanax. When the LVN went to pick up the prescription she was arrested. She feels better now and knows what she did was wrong.

This issue was filed as a complaint and sent to the Texas Board of Nursing. The Texas Board of Nursing has full jurisdiction in all cases that may affect the status of an RN or LVN’s license in the future. But they advise nurses to attend a hearing first before placing the sentence, which the RN attended for her career’s security.

The Texas Board of Nursing investigated the RN and suspended his license.

As a result, the Texas Board of Nursing placed her RN license to disciplinary action. It’s too bad that she failed to hire a criminal nurse attorney for assistance if she had every reason to defend himself in the first place. Her defense would have gotten better if he actually sought legal consultation from a Texas criminal nurse attorney as well.
