Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. The Texas Board of Nurses is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. On or about December 26, 2013, while employed as a Staff Nurse in a medical facility in Austin, the LVN failed to completely and accurately document in the patient’s medical record, regarding the patient’s change in condition and the nursing interventions provided prior to transport to the hospital.

Her conduct resulted in an incomplete medical record and was likely to injure the patient in that subsequent care providers would not have accurate or reliable information on which to base their care decisions.

Because of the incident, the Texas Board of Nursing summoned the LVN. During the defense, the LVN states the only time she left the patient was when gathering the necessary information for EMS during which, another nurse was present with the patient. She called the MD, who did not answer and had to leave a message detailing the patient’s condition. The RN further states the patient was not showing any other signs or symptoms of distress earlier that morning.

The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
