Accusations are stressful issues for an RN or LVN, except when a nurse attorney assists you against the case. The Texas Board of Nurses is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. On or about June 22, 2011, an RN from Houston t left her nursing assignment as the charge nurse on a twenty-six patients unit without notifying the appropriate supervisor. Her conduct was likely to injure patients in that leaving the nursing assignment could have resulted in the patients not getting the care that they needed.
The LVN was summoned before the Board to defend against the case.
In response to the allegations on her, the RN states: “I did not abandon my shift. I spoke to the Interim CNO over the phone. She was threatening me with falsification of documents even though I was completing them as I was trained and in the same manner as the other nurses completed them. She did this in retaliation of my complaint of not enough staffing and for being spoken to in a hostile, unprofessional manner. When I left, there was another RN on duty and I informed the Interim CNO that I was leaving. I have never left in the middle of a shift before. I tried to calm down but was repeatedly called hateful and vindictive. I could no longer function, due to this haranguing, in a safe and prudent manner.”
But without the proper help from a good defense attorney, the LVN lost the case and she was disciplined and suspended.
The Texas Board of Nursing then subjected the LVN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one.
