An RN or LVN who violates the state laws and issuances from the Texas Board of Nursing (BON) should seek proper help from a nurse attorney.  Doing so could make or break their cases. On or about September 7, 2018, through September 14, 2018, while employed as an LVN with a healthcare facility in Garland, Texas, LVN failed to document assessments and education regarding the side effects of newly prescribed medications for four (4) different patients. LVN’s conduct resulted in incomplete medical records and was likely to injure the patients in that subsequent caregivers did not have complete information on which to base their decisions for further care.

On or about September 7, 2018, through November 30, 2018, while employed as an LVN with a healthcare facility in Garland, Texas, LVN failed to document complete vital signs in that she failed to document the temperature for five (5) different patients. In addition, on or about September 7, 2018, LVN failed to document any vital signs on another patient. LVN’s conduct resulted in incomplete medical records and was likely to injure the patients in that subsequent caregivers did not have complete information on which to base their decisions for further care.

In response, LVN attributes missing documentation to system failures at the facility’s rural clinic. LVN states that she often had to take notes by hand when the computer system was down, and she was unable to enter patient data into the computer. LVN states that she would then go back and enter that data later when the computer system was working.

The above actions constitute grounds for disciplinary action in accordance with Section 301.463(b)(10)&(13), Texas Occupations Code, and are a violation of 22 TEX. ADMIN. CODE §217.11(1)(A)&(1)(D) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B)&(1)(C).

The Texas Board of Nursing decided to place the LVN’s license under disciplinary action. It’s because she failed to hire a good nurse attorney for the case, which is why her defense was not matched with the evidence that the Board possesses.
