Accusations are very stressful to any nursing practitioner, except when a nurse attorney assists you against the case. The Texas Board of Nursing is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. Take note that a nurse attorney can also defend a nurse’s license against accusations.

At the time of the incident, the LVN was employed as a Licensed Vocational Nurse at a hospital in Denton, Texas, and had been in that position for ten (10) months.

The Incident happened on or about August 24, 2019, while employed as a Licensed Vocational Nurse, the LVN caused the patient to fall out of his wheelchair after he threw a flashlight into the medication room where the LVN was sitting. The LVN threw open the medication room door, grabbing the handles and spinning the wheelchair causing the patient to fall onto the ground. The LVN’s conduct was likely to cause emotional, physical, and/or psychological harm to the patient and could have interfered or disrupted this patient’s treatment.

In response to the following incident, the LVN denies the allegation and states she grabbed the patient’s wheelchair and turned him towards a co-worker, and then stopped pushing the wheelchair. The LVN relates that the patient then stood up, attempted to walk away, and stepped on his blanket, and fell.

Due to the following incident, the Texas Board of Nursing then subjected the RN and her license to disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the RN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
